| Misappropriation of Rs.7 lakh | | Court directs VOJ to file separate charge sheets | | EARLY TIMES REPORT JAMMU, Oct 9: Dismissing the original challan filed by the VOJ against the then Manager Co-operative society Surankote Parvesh Kumar Kandhari son of Sian Dass resident of Hari Mohalla Surankote, in misappropriation of over Rs. seven lakhs, the Special Judge Anti Corruption B L Bhat has directed the prosecution to bifurcate the charge-sheet and file separate charge-sheets . The case against the alleged accused Kandhari was registered on the complaint of the then Registrar Co-Operative Societies J&K Vijay Kotwal. While dismissing the original challan, Special Judge Anticorruption, after hearing SPO appearing for the VOJ, Adv SC Bali appearing for the accused and after perusing the record, observed that it appears that a consolidated challan in a series of alleged acts of misappropriation covering the period from 1992 ending to 1994-95 was filed by VOJ seeking prosecution of accused on the charges of criminal misconduct with allegations that accused Parvesh Kumar while being posted as Manager Co-operative Society Surankote (District Poonch) committed misappropriation of Rs 7, 36, 810. This Court in terms of order dated December 1, 2006 returned the challan. It appears that prosecution has filed six charge-sheets, five covering series of alleged acts of misappropriation committed within the space of 12 months each. The sixth challan appearing to be the original challan, filed initially, had been returned to prosecution for splitting into separate challans. Thus, the original challan no more survives and no action is warranted on the same and is thus accordingly dismissed. JNF |
