Ex-MLA to undergo brain mapping
BJP’s Jugal Kishore, 2 brothers named in 1999 murder case

JAMMU, Oct 9: As law takes its own course, the former Member of Legislative Assembly from Nagrota constituency is being taken for a narco-analysis and brain mapping to ascertain his involvement, if any, in a murder case.
The former MLA and BJP leader Jugal Kishore along two of his brothers have been arrayed as suspects in murder of one Dina Nath who body was found under mysterious circumstances near Tawi bed near Kishanpur Manwal on March 30, 1999. A case in this connection stands registered with Police Station Jhajjar Kotli.
The progress in the case has been apparently made after dissolution of the state Legislative Assembly as the then MLA probably took benefit of the constitutional immunity to evade brain mapping. For proceeding against legislators in criminal cases permission has to be obtained from the presiding officers of the House. According to Police, a request was made to the Speaker Legislative Assembly in 2007 but a nod could not be obtained till dissolution of assembly on July 10, 2008. Now since the Assembly stands dissolved, the Police have informed court that they will be booking the Ex-MLA for narco-test.
In a status report filed before the court of Chief Judicial Magistrate Jammu, the Investigation Officer, Additional SP (Rural) Jammu informed that a letter has been written to Director General of Police Karnataka for seeking time in Forensic Science Laboratory Bangalore. “As soon the reply is got from the DGP Karnataka, the Ex-MLA will be taken poly-graph, brain mapping and narco-test”, the IO told the court.
According to the status report that on March 30, 1999 reliable information was received that a dead-body is lying in the Tawi river bed under the bridge near Kishanpur Manwal. The dead-body was identified as Raj Singh son of Dina Nath Kothar as death occurred under suspicious circumstances, inquest proceedings under section 174 CrPC was initiated initially. According to the medical opinion of the deceased reveals that death in this case was due to hemorrhage and shock as a result of multiple injuries consequent blunt force impact. All the injuries are anti-mortem and very recent. As per the evidence it was a case of homicide so the inquest proceedings was closed and a case under section 302 RPC (murder) was registered in the Police Station Jhajjar Kotli.
In the course of investigation, IO of the case recorded the statement of 69 witnesses but no concrete clue regarding the actual culprit could be struck out. However, three persons namely Jugal Kishore (Ex-MLA of area), Nand Kishore, Ganesh Kumar alias Munna all sons of Bal Krishan residents of Kishanpur Manwal, emerged as suspects in the case on which the above named persons accept Jugal Kishore were questioned but no break through was achieved. Later the case was closed as untraced and final report of the case was submitted on March 28, 2006. Special Municipal Magistrate Jammu vide order January 8, 2007 has ordered for reinvestigation of the case by any senior police officer of the rank of Additional Supt of Police and also directed that Poly-graph Test and Narco Analysis test in respect of suspect persons Jugal Kishore, Nand Kishore, Ganesh Kumar alias Munna. As per the direction of the court and to collect the evidences to nab all the culprits involved in the case a letter regarding accord of permission for poly-graph/ Narco Test of Ex-MLA of area Jugal Kishore has been written to SSP Jammu for taking-up the matter with the speaker of J&K Assembly and further correspondence has been made to the senior police officers by SSP Jammu. But permission regarding conducting of said tests was not received from the speaker of J&K Assembly; meanwhile assembly was dissolved in the first week of July 2008.
According to the status-report on July 14, 2008 after assuming the charge of Additional SP Rural Jammu, the investigation of the case was handed over for onwards investigation. Meanwhile due to the recent strike call by SAYSS, IO was busy in maintaining law and order duty, the Samiti called off strike in the Ist week of September. After that Additional SP Rural the IO of the case perused the case diary and visited the scene of occurrence on September 14, 2008 along with Incharge PP Manwal for further investigation of the case. Since the J&K Assembly has been dissolved in the month of July, there is no need of accord of permission for conducting the poly-graph/ Narco Test of Ex-MLA Jugal Kishore for which the investigation of the case was pending. Therefore, a letter regarding conducting of poly-graph, brain mapping and Narco Analysis Test of the suspect Jugal Kishore Ex-MLA of area, Nand Kishore and Ganesh Kumar alias Munna all real brothers, has been written SSP Jammu requesting to take-up the matter with DGP Karnataka and Director Forensic Science Laboratory Bangalore, as forensic science laboratory Bangalore is well-equipped and having expertise in conducting such tests, for which SSP Jammu has approached through to a letter to the DGP Karnataka and Director Forensic Science Laboratory Bangalore vide dated September 24, 2008 for which reply is awaited. As soon as the reply regarding conducting the test is received from FSL Bangalore, the said test will be got conducted and investigation of the case will concluded on merits, status report said.
