| Court asks DC to file affidavit | | Kathua Govt quarters | | EARLY TIMES REPORT
JAMMU, Oct 14: Taking strong exception to the unauthorized occupation of government quarters at Kathua, the Division Bench of the Jammu and Kashmir High Court comprising Chief Justice Manmohan Sarin and Justice Sunil Hali today directed Deputy Commissioner Kathua to review the situation and file her own affidavit giving dates from which the premises are in unauthorized occupation as also the proceedings initiated for eviction of such unauthorized occupants within a period of two weeks with an advance copy to Advocate SK Anand assisting the Court in this PIL.
Treating a newspaper report as PIL, the Division Bench on September 19 had directed DC Kathua to submit status report. The status report signed by Executive Engineer Irrigation Division Kathua and filed in the court indicate that 35 quarters are in R&B Revenue Colony, 50 quarters in Ravi Tawai Irrigation colony and three quarters in Irrigation Division Kathua and are stated to be under unauthorized occupation.
The DB while pursuing the status report observed that the annexure filed does not indicate the date from which the occupation is unauthorized as also the steps taken for eviction of unauthorized occupant. The DB directed that Deputy Commissioner Kathua would review the situation and file her own affidavit giving the dates from which the premises are in unauthorized occupation
DB, after hearing Adv SK Anand assisting the Court in this PIL and Adv Vikram Sharma appearing for the state, directed the Registry to re-notify the case on November 10, 2008 before a bench comprising Justice Sunil Hali and Chief Justice or the senior most Pusine Judge at Jammu. JNF |
