| HC stays transfer of Asst Comptroller of SKAUST | | | EARLY TIMES REPORT JAMMU, Oct 17: Justice Nirmal Singh of J&K High Court Jammu wing today stayed the transfer of the petitioner Assistant Comptroller Sher-e-Kashmir University of Agricultural Sciences and Technology Jammu who was transferred within a period of 15 days from one post to other post. According to the case the petitioner was promoted as Assistant Comptroller and adjusted in the office of Comptroller SKAUST Jammu. Subsequently the petitioner was permanently adjusted at the head quarter vide order dated September 15, 2008. In pursuant to the said order the petitioner assumed charge on September 16, 2008, but subsequently on October 3, 2008 the order dated September 15, 2008 was modified and ordered that Rakesh Kapoor respondent No 5 and petitioner Manmohan Singh shall exchange their place of posting. Adv DS Chouhan appearing for the petitioner submitted that once the order has been implemented and acted upon then the competent authority has to give reasons for modifying the same. In support of his contention the said advocate referred various judgments. Justice Nirmal Singh, after considering the arguments of the counsel appearing for the petitioner, issued notice to the Vice Chancellor, Registrar, Comptroller, Associate Dean Faculty of Veterinary Sciences and Rakesh Kapoor Accounts Officer Faculty of Veterinary science all of SKAUST and directed the respondents to file objections within four weeks and in the meanwhile operation of the impugned order dated October 3, 2008 is stayed.
