Court granted interim anticipatory bail to Director Local Body involved in backdoor appointments

Jammu, September, 12:- Special Judge Anticorruption Jammu Mr. JR Kotwal today granted interim anticipatory bail to Mohinder Singh the then Director Local Bodies involved in illegal appointments in NAC Katra with the direction to the IO that in the event of his arrest during pendency of this application, he be released on his furnishing personal bond along with a surety in the amount of Rs 10,000/- each. Court also directed petitioner that he shall take part in the investigation as and when required by the investigating officer.

According to Vigilance Organization that in a complaint regarding illegal appointments made in the Notified Area Committee Katra, a preliminary verification was conducted, which revealed that the Mohinder Singh the then Director Local Bodies Jammu, Ravi Kumar Incharge Executive Officer NAC Katra and others hatched a criminal conspiracy and made illegal appointments in the NAC Katra and thereby abused their official position.

During the investigation of the case it was found that M/S Anoop Sharma s/o Vidya Dhar r/o Panthal (Tax Collector), Vikram Sharma s/o Madan Lal r/o Jammu (Junior Assistant), Amit Sharma s/o Jagdish Raj Sharma r/o Jammu (Junior Engineer), Ashok Kumar s/o Vakila Ram r/o Jammu (Tax Collector), Ram Pal s/o Suraj Ram r/o Katra (helper to lineman), Mohan Lal s/o Tirath Ram r/o Katra (cattle pond catcher) and Mohan Lal s/o Lok Nath r/o Katra (cattle pond catcher) have been appointed in regular grade. The record of these appointees, however, preliminary scrutiny reveals that Anoop Sharma s/o Vidya Dhar, who is brother-in-law (loser) of Executive Officer NAC Katra, was initially engaged as casual labour in NAC Katra on October 1, 2000 and later engaged on consolidated pay of Rs 2550/-. As per draft note-sheet moved by Mr. Ravi Kumar Incharge EO NAC Katra on July 18, 2001, the then Director Local Bodies Jammu while on tour to Katra had verbally directed to issue regularization order of Anoop Sharma as Tax Collector. Accordingly Ravi Kumar Executive Officer Katra issued temporary orders subject to conformation of Director Local Bodies Jammu. The then Administrator Mr. Sham Lal Sharma to whom the file was put up opined his note that order be sent to Director Local Bodies for conformation, however, the then Local Bodies Mr. RK Handa did not confirmed the order, later Mr. Mohinder Singh who assumed the charge of Director Local Bodies gave approval for regularization of Anoop Kumar. The said appointee within less than one and a half month was transferred from NAC Katra to NAC Ramnagar along with post. In the report it has been submitted that since the investigation of the case is at initial stage and if the accused is enlarged on bail, he may tried to influence the witnesses and temper the material evidence by virtue of influenced of his post, which he is holding.

Court after considering the objections filed by the SPO granted interim anticipatory bail.
