| EC rejects transfer of DCs, SSPs | | Home Secretary’s transfer upheld; caution put for future | | EARLY TIMES REPORT JAMMU, Oct 21: The Election Commission of India has confirmed its first snub to the Jammu and Kashmir government by staying most of the transfers of senior officers in administration and police ordered on the eve of poll announcement. The Commission has though confirmed the change of guard in Home Department but it has refused to approve transfers of the Deputy Commissioners. The Election Commission has not approved some of the transfers effected by the Jammu and Kashmir Government minutes before the EC announced the unprecedented seven-phase polls in the state on October 19. The EC, however, has cleared the appointment of Kursheed Ganai as the new Home Secretary replacing Anil Goswami, who has been transferred as Financial Commissioner (Revenue), the EC sources said. They said the EC had not cleared the transfer of Deputy Commissioners Gazzanfer Hussain, Mohammed Afzal Bhat and Sudershan Sharma of Anantnag, Poonch and Kishtwar respectively. They said the transfer of Superintendent of Police Leh and Poonch S R Samuel and Basant Kumar Rath respectively and Additional SP of Jammu (Rural) Keshav Ram Chaurasia have been stopped. Regarding the transfer of SP (Kargil), the EC has asked the state government to provide a panel of officers after which a decision could be taken. "The state administration said it had sent the proposal regarding transfers to the Commission which would be considered tomorrow," EC sources said. Transfers of 14 IAS and KAS officers were ordered an hour before the EC announced on Sunday that the state is going for seven-phased Assembly polls in November-December. Meanwhile, with the announcement of Assembly elections in Jammu and Kashmir by the Election Commission of India (ECI), the General Administration Department (GAD) here has issued a circular for strict compliance of the Model Code of Conduct (MCC). The GAD issued instructions concurrent to the provisions of the MCC which came into force with immediate effect for candidates, political parties, the State Government and the Union government. As per circular, instructions have been issued for strict compliance of the MCC issued by the ECI. No official can take shelter under the pretext that he has not been apprised of the coming effect of the MCC for want of a separate communication in this regard. The instructions further stated that any such attempt by any official, which could lead to the circumventing of the provisions of the code, would be viewed very seriously by the ECI. The circular further said no fresh release of funds under the Member of Parliament (including Rajya Sabha Members) Local Area Development Fund will be made. Similarly, no fresh release of funds under the MLA and MLC Local Area Development Fund shall be made, if any such scheme is in operation, till the completion of the election process. No work will start in respect of which work orders have been issued before the issue of this letter but the work has actually not started in the field. These works can start only after the completion of the election process. However, if a work has actually started, that can continue. The order further said there will be no bar on the release of payments for completed works subjected to the full satisfaction of the concerned officials. The ECI has drawn particular attention of all concerned to clause VII (vi) of the MCC which, inter alia, states that from the time elections are announced by the Commission, Ministers and other authorities shall not announce any financial grants in any form or make promise thereof or (except Civil Servants) lay foundation stones of projects or schemes of any kind. The Ministers and other authorities have also been barred from making any announcements with regard to promise of construction of roads, provision of drinking water facilities or make any ad hoc appointments in Government, Public Undertakings which may have the effect of influencing the voters in favour of the party in power.
