Court asks Govt to consider permissions

JAMMU, Oct 22: Justice Hakim Imtiyaz Hussain of J&K High Court, Jammu wing, today in batch of writ petitions filed by Institutions conducting ETT Courses, challenging the Government policy / guidelines for issuance of "No Objection Certificate", directed the respondent state and its functionaries to reconsider the cases of petitioner's institutions for grant of no objection.
In the batch of these writ petitions Sr. Adv SS Lehar, Advocates Sunil Sethi, Nitin Bhasin, Rakesh Sharma appeared for the petitioners whereas Deputy Advocate General Neeru Goswami and Adv DS Thakur appeared for the respondents. The petitioner's institutions seeking quashment of Government order dated July 24, 2008 on the ground that under the policy and guidelines, the respondents are required to consider the cases of the petitioner's institutions and putting the cases on hold is likely to affect the right of the institutions.
While disposing off these petitions, Justice Hussain observed that counsel appearing for the respondents submitted that the Government has decided to re-examine the cases along with the cases which are pending and also the cases which were put on hold in view of the Government order dated July 24, 2008 in the light of policy/ guidelines applicable to such cases without resorting to Government order July 24, 2008, impugned in the present cases. Court further observed that in view of the peculiar facts and circumstances, the counsel appearing for the petitioners, has got no objection for the disposal off these petitions at this stage. These petitions, are therefore, disposed off with a direction to respondent state and its functionaries to reconsider the cases of petitioner's institutions for grant of No Objection, un-influenced by the Government order July 24, 200 and pass appropriate order within a period of two weeks from the date this order is served upon the respondents, Court ordered.
