| Asked to serve under junior, DFO gets transfer stayed | | | EARLY TIMES REPORT JAMMU, Oct 22: Justice Nirmal Singh of J&K High Court Jammu wing today stayed the operation of Government order dated September 9, 2008 whereby the petitioner, who was attached in the office of Principal Chief Conservator of Forest, has been transferred and posted as DFO Batote Forest Division. The said posting was challenged by the petitioner on the ground that the Conservator Forests of Chenab Circle was junior to the petitioner. The petitioner submitted that by virtue of the government order No. 334-FST of 2008 dated September 9, 2008, he has to work under his junior who is working as Conservator of Forests Chenab Circle. Adv DS Thakur appearing for the petitioner submitted that petitioner has challenged the induction of Mukherjeet Sharma and others, from State Forest Service to Indian Forest Service (IFS), in the year 1995 which was quashed by the Supreme Court of India vide judgment February 26, 2007. Justice Nirmal Singh after hearing the counsel for the petitioner issued notice to the state of J&K through Chief Secretary and Principal Secretary Forest returnable within four weeks and directed that, in the meanwhile, the operation of impugned Government order dated September 9, 2008 shall remain stayed.
