A 75 years lineman who is six older than his son

JAMMU, Oct 22: The Power Development Department has a lineman who is 75 years old, still serving and just six years older than his son.
The court is examining the facts as how a 1929 born gentleman who retired from the Army in 1964 managed a government job on forged documents.
Crime Branch Jammu has produced the challan in the court of city Judge (JM) against the accused person Rashpaul Singh son of Samunder Singh Manhas, a resident of village Shama Chack Tehsil Jammu in case FIR No. 04/2008 dated 23.02.2008 investigated by Crime Branch, Jammu.
Brief facts of the case are that a complaint was received in Crime Headquarters wherein it is alleged that accused Rash Pal Singh is an Ex-serviceman from J&K Rifles and retired in the year 1964, who at present is more than 75 years. The accused Rash Paul Singh after his retirement from the Army managed to procure fake and fraudulent date of birth certificate and has concealed the actual facts of his having served in the Army. It is further alleged that the said Rashpaul Singh managed to get job in the Power Development as lineman by producing fake and fraudulent certificate of his date of birth. The said accused at present is serving in the Electric., M&RE Division-III Mubarak Mandi, Jammu and is drawing pension salary from the Army and regular pay from the PD Department. A verification into the above mentioned subject was got conducted through Chief Engineer, Maintenance and RE Wing. PDD Jammu reveals that the date of birth of the Rashpaul Sigh accused as per service record is 17.04.1950. This shows that the difference of age between a father and son is just six year, which is next to impossible. Thus either the father or son has furnished fake date of birth to the Department at the joining of Govt. job etc.
Accordingly P.E was initiated into the matter in Crime Branch Jammu and a formal case was registered under sections 420, 471 RPC in P/S Crime Branch Jammu.
During the course of investigation relevant record was seized from the office of Executive Engineer, Elect. & Maintt. R.E. Wing Division-III Jammu and Chief Engineer Elect. Maintt. R.E. Wing Jammu. The service bio-data of the accused Rashpaul Singh lineman P.D Department was got verified from records of J&K Rifles, Jabalpur and verification report with regard to bio-data was obtained. The statements of the concerned witnesses were recorded U/S 161 Cr.PC. investigation further revealed that accused was enrolled in the J&K Rifles on 11.09.1949 as a rifleman and Army No. 13710813 was allotted to the said accused person. The date of birth at the time of his enrolment in the Army exist on 11.02.1929. The said Rashpaul Singh was brought on Regular Army enrollment on 31.10.1957 and subsequently, he was retired from the Army on 12.02.1966 and the accused is also getting pensionary benefit from the Army.
Investigation further revealed that the above said accused person after his retirement from the Army managed to get him engaged as daily wagers during May 1971 in the Elect. Maintt. & R.E. Department Jammu. The accused later on was regularized as junior lineman among other daily wagers. The above said accused on his regularization and preparation of service book has produced his fake date of birth horoscope as 17.04.1950, whereas the said accused has will fully concealed his actual date of birth and age at the time of his regularization and has also concealed with regard to his previous service of the Army. In this way the accused on the basis of fake date of birth has overstayed i the service with the department for the period of about 19 years by way of cheating to the department.
In view of facts surfaced during the investigation offences U/S 420, 471 RPC are prima facie established against the accused person which has been challaned in the Court of Law for Judicial determination.
