| Court rejects bail of alleged charas smuggler | | | EARLY TIMES REPORT JAMMU, Oct 24: Rejecting the bail application of Vijay Kumar facing trial under NDPS Act, the Ist Additional Sessions Judge Jammu Puneet Gupta observed, the accused, who is facing charges for allegedly possessing commercial quantity of Charas cannot be bailed out on the basis of arguments raised by the counsel for the accused. Court is not inclined to agree with the argument of counsel for the accused at this stage. The court further observed though the report of chemical examiner S.R.C.L New-Delhi states that at present THC (Tetrahydrocannabinol) content could not be determined. Admittedly the report of quantitative analysis is not on the file. Though the percentage contents of THC is not mentioned in the report as well as the statement of chemical examiner, it does not mean that Court is to give final opinion that the article allegedly seized was not Charas. If the examiner has issued the report concluding that the article examined by him is Charas, while concluding quantitative tests, Court cannot come to the rescue of the accused by finally holding that the Article seized was definitely not Charas. In any case, the prosecution evidence is not yet over and the prosecution has still to produce evidence in the case and hence the bail application is dismissed. JNF |
