Court rejects bail of history-sheeter

JAMMU, Sept 1: City Judge Jammu Manjeet Singh Manhas rejected the bail application of history sheeter namely Vishu Sharma.
While rejecting the bail application, City Judge Manjeet Singh Manhas after hearing APP Arvind Rathore observed that s per police report accused along with other accused persons is involved in case arising out of the FIR No. 124/2021 registered in P/s Bakshi Nagar, Jammu under offences U/S364, 382, 323, 147 IPC, 3/25, 4/25 Arms Act regarding the Abduction, rioting, theft and use of pistol and sharp edged weapons. Accused Vishu and his two other accomplices have been arrested after much effort only on 17-08-2021. As the instant application is premature and merits rejection at this infancy stage of investigation. Since the accused is History Sheeter, earlier also found involved in the commission of alike unsavoury and dastardly acts registered in P/S Nowabad as FIR No. 146/2010 under offences 307, 341, 34, RPC 4/25 Arms Act FIR No, 119/2013 U/S 307, 341, 34, RPC 4/25 Arms Act, FIR No. 28/2014 U/S 307, 458, 427, 147 RPC 4/25 Arms Act FIR No. 92/2014 U/S 307, 458, 342, 147, 148, 149, 323 RPC FIR No. 150/2014 U/S 451, 427, 506, 323 RPC. and there is also reasonable apprehension that in case the concession of bail is extended to the accused at this stage, he will flee from the course of justice besides would cause impediment and obstacle in the completion of investigation, as such the accused is not entitled to be released on bail at this stage. 4. Perusal of police report reveals that on 17.08.2021, Sanjay Kumar S/O late Jattu Ram R/O House No. 42/E Shiv Nagar, Jammu filed an application on behalf of Complainant namely Sachin Kumar S/O Ashok Kumar R/O House No. 16-B Rajpura Mangotrian, Jammu seeking registration of FIR against Vishu @ Vishu Kalia @ Kalia S/o Unknown R/o Bhagwati Nagar and four unknown persons for kidnapping assaulting him. Last night the complainant alongwith Harjinder Singh and Yogesh Sharma was going home when they reached opposite Raina Electronic Vishu along with four unkown persons came in Foituner Car and kidnapped them in the car and took them to Bhagwati Nagar near DRDO hospital. After reaching there, they took them out of the car and started beating them. Meanwhile Yogesh managed to escape from the spot after that they put off all his clothes and started beating him with iron rods. They undressed him and forcefully inserted an iron rod inside anus and recorded the whole incident in mobile phone against his wishes. They all were having pistols and sharp edged weapons and Vishu pointed Pistol on his head and threated him of dire consequences if he report the matter to any one including Police. They also snatched his purse containing Rs. 4500/- from his pocket and one golden chain weighing around 08 Gram from his neck. They beat him with fist and blows, abused him and threatened him that they have high connections no one can dare to take said application, FIR No. 124/2021 for commission364/147/382/323-IPC 3/25, 4/25-A.Act registered in the police station BaKshi Nagar and investigation started. During investigation the I.O went to GMCH hospital to enquire about the complainant and found that the complainant was admitted in the hospital. On 17.08.2021, the 10 arrested 3 accused persons namely 1. Vishu Sharma S/O Suraj Parkash R/O Puran Nagar Bhagwati Nagar; Jammu 2. Munish Kumar Thapa S/O Madan Lai Thapa R/O Sunder Nagar Sarika Vihar Talab Tillo, Jammu 3. Vishal Mehra S/O Thodu Ram R/O House No. 751 Main Road Bhagwati Nagar, Jammu and also seized the vehicle used in the alleged crime bearing registration No. JK 02 BU-2225. The other accused persons allegedly involved in the commission of crime are absconding. Earlier also FIR No. 1, 146 /2010 U/S 307 /341/24 RPC 4/25 -A.Act , 2, 119/2013 U/S 307/341, 34-RPC 4/25-A.Act, 3, FIR No. 92/2014 U/S 458/342/307/147/148/149/323 RPC, 4, FIR No. 28/2014 U/S 458/427/307/147 4/27-A.Act, 5, FIR No. 150/2014 U/S 451/323/427/506 RPC have been registered in the police station Noawabad and the challans have been filed in the court against the accused Vishu Sharma S/O Suraj Parkash Sharma. The accused Vishnu Sharma is already a history sheeter in the police station of Noawabad.
