4 cops write to Govt against Justice Sharma Commission

JAMMU, Nov 1: On the eve of completion of two months of Amarnath land row agitation agreement, the Shri Amarnath Yatra Sangharsh Samiti has said that four Police officers are making deliberate and malafide attempts to derail the course of the justice.
The Sangarsh Samiti has, however, not indicated any course of action on the matter except that it will seek an appointment with the Government to draw his attention to the case and for prevalence of the instruments of justice.
It may noted here that four Police officers –SSP Alok Kumar, SP Shalinder Singh, DySP Mohan Lal Kaith and Swatantra Arora –have written to the Law Department against Justice OP Sharma Commission of Inquiry. Justice Sharma’s one-man commission is looking into the allegations of desecration of the body of Kuldeep Dogra who had allegedly committed suicide during the Shri Amarnath land row.
The Police Officers have said that Justice Sharma is unduly favorable to the Sangharsh Samiti is working under influence of a BJP leader who is also associated with the Sangharsh Samiti.
The Justice Sharma Commission had issued notices to all concerned who were acquainted or conversant with the incident of alleged desecration for filing the affidavits. In response thereof, different persons including widow of the deceased Shilpi Verma, elder brother of the deceased Surinder Kumar as well as many other persons from Bishnah town and members of the Samiti including L.K Sharma, Advocate (Convener of the Samiti), commission has recorded the statements of incharge Police Station Bishnah, Brham Dev Singh, Convener Samiti L.K Sharma, Prof. Nirmal Singh, Vinod Gupta, Indu Bhushan, Narayan Dutt, Satish Sharma.
The commission had further fixed the dates for recording further evidence as October 31 and November 2. Brother and widow of the deceased were present before the commission on October 31 for recording their statements.
However, on same day an application was moved by four police officers SSP Alok Kumar, SP Shailendra Singh, DySPs M L Kaith and Swantanter Arora to the Law Secretary alleging illegalities by the commission including undue favour to the Sangarsh Samiti members. The application further attributed to the commission of being under the influence of Advocate Ramesh Arora representing the Samiti and Kamlesh Proch. “The Police personnel have thus challenged the credentials of the commission on frivolous, false, fabricated and manipulated allegations and grounds”, said four lawyers including Ramesh Arora, Chander Mohan Sharma, Sunil Sethi, Karnika Sharma, K.K Proch addressing a press conference here today for the Sangharsh Samiti.
“It is manifestly a known fact that the presiding officer of the commission is an undisputed personality who remained as the Judge of the High Court and in whom the Jammu public has full faith but the application has been made with the sole intention to prolong and delay the proceedings before the commission and hoodwink and temper the evidence which has to go against the Police personnel. In the circumstances, the commission has adjourned the proceedings saying that government should decide the application immediately”, the lawyers said in their statement.
The Samiti’s lawyers alleged that “the government’s top officials have entered into a dubious conspiracy to win over the witnesses and to hoodwink the proceedings of the commission which otherwise were going smoothly”.
The Samiti has now urged the Governor to intervene and instruct the commission to proceed with the matter in hand as there is no law which can stop the commission for conducting the proceedings. “It is a high and right time for the Governor to prove his commitment earnestly and show faith ion the legal system and trust in the commission which is being shaken by the Police personnel”, said the lawyers.
The lawyers further said, “we are informed by the Samiti that it has decided to call on the Governor and talk to him on this issue as equality before law and law of the land must prevail against any person how so ever high he may have been placed”.
