| Nomination on Indian stamp papers denied | | | EARLY TIMES REPORT JAMMU, Nov 1: Controversy has erupted on the nomination papers of candidate for assembly elections presently serving jail term on charges of militancy. Mohammad Iqbal Jan serving in Tihar Jail has filed his nomination papers from Bandipore constituency as Panthers Party candidate but the Returning Officer declared his papers invalid as he had sworn on a stamp paper of Indian Stamps and not Jammu and Kashmir Stamp Papers. Now his case has been referred to the Election Commission for a decision. Scrutiny of the nomination papers of Mohammad Iqbal Jan who is presently in judicial custody in Tihar Jail at New Delhi, was taken up today. The Returning Officer taking suo-moto notice that Indian Stamp Papers are not valid in Jammu and Kashmir attempted to reject his nomination but Sanjoy Sachdev, President, Delhi Pradesh National Panthers Party who represented the party objected to the Returning Officer. The Returning Officer quoted Section 18 of J&K Stamp Act for it while Sachdev maintained that any person can swear an affidavit at the place of his physical presence and as Mr. Iqbal is lodged in Tihar Jail he can only present with Indian Stamp Paper and not of J&K. He said that Mr. Iqbal who is charged with militancy has born an oath to the Constitution of India which is a major thing. The Returning Officer has referred the nomination to the Chief Electoral officer, J&K. |
