| 17 years imprisonment for militant | | He was facing trial in Explosive Substance Act | |
Jammu, September, 13:- Presiding Officer TADA/POTA/Third Additional Sessions Judge Jammu Wani ND today awarded 17 years rigorous imprisonment to militant Abdul Noorani, who was facing trial under Arms Act and Explosive Substance Act.
According to the Police case on May 5, 1998, accused Abdul Noorani was arrested by the police during the interrogation he disclosed before the police that he had kept the arms and ammunition near Railway Station. After recording disclosure statement of Abdul Noorani and at his behest recovered AK 56 Rifle (1), Magazine AK-56 (3), Cartridges AK-56 (91), pouch of arms and ammunition (1), Hand-Grenade (2), Detonators (2), after recovery all these arms and ammunition a case u/s 7/25 Arms Act and 4/5 Explosive Substance Act was registered and after completion of the investigation, Challan was presented in the competent Court of law.
Presiding Officer under TADA/POTA Wani ND after hearing Additional Public Prosecutor Mr. Gulzar Singh Charak and Advocate Mr. Subash appearing for the accused, the accused also present in custody, observed that the accused is apparently a poor person; therefore, he deserves a lenient view to be taken against the accused. In the circumstances of the case, the accused is sentenced to undergo rigorous imprisonment u/s 7/25 Arms Act for a period of 9 years and shall pay fine of Rs 5000/-. The accused further sentenced to undergo RI for 5 years u/s 4 Explosive Substance Act and shall pay fine Rs 1000/-, u/s 5 of Explosive Substance Act accused shall undergo imprisonment for 3 years and shall pay fine Rs 1000/-. Court further ordered that all the sentences shall run concurrently.
