Court summons Forest Secretary

JAMMU, Nov 5: Taking serious note of the state functionaries in delaying filing the requisite reply and depositing the cost, despite opportunity granted, Justice YP Nargotra of J&K High Court Jammu Wing in a petition filed by SA Salaria the then Chief Conservator of Forest, has directed the Additional Chief Secretary Forests to appear in person along with the relevant record on the next date of hearing.
The petitioner in his petition filed through Adv CS Azad submitted that while the petitioner was posted Project Chief Integrated Water Shed Development Project (Hills) being senior most, was due for promotion to the post of PCCF or equivalent post but some vested interests implicated the petitioner allegedly in the case of change of his date of birth as a result of which he was removed from the post of project chief IIWDP in the month of April, 1999 and thereafter retired from the government service in October 1999 with effect from September 30, 1998. However, since the petitioner remained in service up to October 13, 1999 filed a writ petition regarding his date of birth challenging the enquiry conducted by the departmental authorities. The petition was finally decided in favour of the petitioner and in terms of the judgment the petitioner was also given the salary up to the October 13, 1999. The present grievance is that no retirement benefits including release of 10 months leave salary was given to the petitioner. According to the petitioner despite the representation for release of pensionary benefits the same have not been still released. JNF
