Petition seeking transfer of FIR regarding purchase of Rs 300 crore property on fake PRC

JAMMU, Oct 28: Ex-MLA Baldev Sharma has filed a petition seeking direction to transfer the investigation and all other proceedings in relation to the FIR registered against Swaran Singh Salaria who allegedly purchased 300 crore property on fak PRC from Reasi Police to SSP, Crime Branch Jammu or any other agency for fair and impartial investigation. Justice Sindhu Sharma of High Court after directed investigating officer along with Case Dairy file shall appear in person. In the petition it has been submitted that the petitioner had called the status report vide application dated 28-2-2018 in FIR No.4/2011 under section 467, 468, 471 and 420 RPC on 06-01-2011 at P/S Reasi before the JMIC, Reasi and the SSP Reasi had filed the status report wherein it has been revealed that no step has been taken by the respondent No.3 and 4 to carry out the further investigation in the FIR and they also failed to file the Challan against the accused. It has been submitted that till date the inquiry regarding the PRC is pending and the original PRC has not been seized from the private respondent and the private respondent has not been arrested/interrogate till date. The grievance projected by the petitioner in this petition is that an FIR against Salaria for commission of offences under section 467, 468, 471 and 420 RPC was registered in the Police Station Reasi on 6-1-2011. The Police Station, Reasi after concluding the investigation submitted a closure report before the Court. The petitioner claimed that he lodged a protest petition before the Court which was accepted and the case was sent back for re-investigation to be conducted by an officer not below the rank of DySP. He alleged that the investigating officer is going slow because of the influence of Salaria. Justice Sharma observed that the respondents have filed fresh status report. The Court asked the investigating officer to be present along with the case diary in the Court on the next date of hearing.
