| Lifer for father, sons in murder case | | | EARLY TIMES REPORT REASI, Nov 12: Principal Sessions Judge Reasi AK Koul today awarded life imprisonment to Dewan Chand and his two sons Jai Gopal and Deep Kumar residents of Garn Jagir Tehsil of Reasi who were facing trial in a murder case of Parasram which took place on May 14, 2001. According to the prosecution case the accused persons killed one Parasram on May 14, 2001 on long standing enmity over a piece of land. A case was registered u/s 307/341 RPC and in the meantime the condition of the injured became worst and was referred to Jammu where he succumbed to injuries and a case u/s 302 was registered and accused were arrested. After the completion of the investigation, the Reasi police submitted a challan in the Court which was decided today after more than 7 years. Principal Sessions Judge, after hearing PP MM Sharma appearing for the state and Adv Rupak Ratta appearing for the accused persons, observed that statement of deceased Parasram son of Managt Ram resident of Garn Jagir aged 54 years died on May 14, 2001. Vide the judgment dated November 11, 2008, the accused after having been found guilty of section 302/ 341/34 RPC have been convicted for the commission of said offences. Today they were heard on the quantum of sentence. They have admitted that they are the members of a same family and have a poor social back-ground. Apart from being young they are the sole supporters of their family and as such a deterrent sentence may not only eliminate them from the society but would also expose their families to grave starvation. They have pleaded that their families have no one to feed back. Court said that genuine sentence has always been difficult as biting a bullet. Generally speaking the punishment must commensurate to the crime committed. It is true that gallows may avenge the dead. The heinousness of the crime committed by them may demand a long period of their detention, so that they can repent and think of their reformation. It is now almost a rule that the extreme penalty of death in case of murder should be awarded in rarest of rare case when the imprisonment for life would not be adequate to punish the criminal keeping in view the magnitude of crime and the manner in which it was committed and referred a judgment of Supreme Court and awarded life imprisonment to Jai Gopal, Deep Kumar real brothers and Dewan Chand their father u/s 302 RPC and fine Rs 10,000 each. |
