Court rejected bail application of Jaish-e-Mohammad activists

Jammu, September, 14:- Chief Judicial Magistrate Jammu Mr. Sanjay Dhar today rejected the bail application of Mod Bashir s/o Ghulam Rahani r/o Kantha Tehsil Sunderbani District Rajouri, who is according to police a member of banned Jaish-e-Mohammad Organization.



According to the police case on August 28, 2006 Jhajjar Kotli police received information that Mohd Bashir who is a member of banned Jaish-e-Mohammad Organization has brought cash to Salwara for handing it over to other militants of Kashmir namely Farooq Ahmed Bhat and Mustaq Ahmed Bhat. On the base of this information, police swing into action and raided the hideout of the militants and arrested all the three above mentioned named militants. The police recovered Rs 35000/- in cash from the possession of Mohd Bashir and also recovered Mobile Phone one each from the arrested accused. The accused were sent to JIC for their interrogation where it was found that accused Mohd Bashir a member of banned Jaish-e-Mohammad Organization, as per the instruction of the master of the said organization, he was deliver the cash to other accused who are also militants and that this cash was to be used for funding terrorist activities in the state of J&K. police on the basis of investigation registered a case u/s 17/21 of Unlawful Activities (Prevention) Act.



Chief Judicial Magistrate Jammu Mr. Sanjay Dhar after hearing Chief Prosecuting Officer Maroof Manhas appearing for the stated resisted the bail application on the ground that the accused is if released on bail it will jeopardize the security of the state whereas the investigation of the case is still in progress. Upon this Court gone through the objections and police report as well as case dairies, further observed that so far as the nature of accusations is concerned the same are very serious in nature, accused is alleged to be a member of banned organization Jaish-e-Mohammad. This organization cessation of the state of J&K from Union of India and in this direction it indulges in indiscriminate killing of innocent people. The organization was found to be involved in such dastardly acts like attack on Indian Parliament to be a member of such an organization is in itself a serious accusation. Than there are allegations that accused was holding money of the said organization in order to distribute the same to other members of the organization. This allegation is also very serious in nature.



Court further observed that it will not be in the interests of security of state to enlarge the accused on bail. The whole word particularly India is suffering heavily due to militant’s activities. Day in and Day out we came across news about terrorists activities like killing of innocent people in bomb blast if the members and persons who are holding and distributing funds of terrorists organizations are enlarged on bail, the menace of terrorism will receive shot in the arms and militants will get encouragement in carrying out subversive activities. With these observations Court dismissed the bail applications of the accused.
