| 15 years jail for kidnap, rape | | | EARLY TIMES REPORT
RAMBAN, Nov 18: Principal Sessions Judge Ramban RS Jain today awarded 15 years imprisonment to Parvez Ahmed and 12 years each to other four accused, facing trial in kidnapping and raping of a minor girl as back as December 2001.
Those convicted included Imtiyaz Ahmed, Tanveer Ahmed, Swami Raj and Farooq Ahmed.
Principal Sessions Judge, after hearing Public Prosecutor appearing for the state and RP Katoch and T H Malik Advocates for the accused, who were also present under custody, observed that prosecution has established its case against the accused persons and as such are awarded sentence. Parvez Ahmed son of Mohammed Hussain resident of Batote is sentenced to undergo imprisonment for 10 years u/s 376 and five years u/s 363 whereas accused Imtiyaz Ahmed son of Mohammed Salim Margray, Tanveer Ahmed son of Shabir Hussain, Swami Raj son of Tilak Raj Jagat , all residents of Batote and accused Farooq Ahmed son of Siraj Din resident of Nai-Basti Jammu are awarded seven years imprisonment us/ 376 and five years imprisonment u/s 363. Court directed that all the sentences shall run concurrently.
The father of the prosecutrix on December 21, 2001 lodged a written complaint about missing of his minor daughter on December 17, 2001 and the search party was unable to trace her. However, during search, the complainant came to know that his minor daughter had been kidnapped by accused Parvez Ahmed and Swami Raj, driver. On receipt of this complaint the police registered the case u/s 363/109 RPC. During the course of investigation the police recorded statements of witnesses and seized Maruti Van and arrested its driver Swami Raj and also recovered the prosecutrix from the house of Farooq Ahmed situated at Nai-Basti Jammu. After recording the statement of prosecutrix Tanveer Ahmed and Imtiyaz Ahmed were also arrested. On December 17, 2001 Parvez Ahmed along with Farooq Ahmed, Tanveer Ahmed, Imtiyaz Ahmed and Swami Raj kidnapped the prosecutrix in the van and took her to the house of accused Farooq Ahmed where accused Parvez Ahmed raped her. |
