| Azad’s kin wants transfer to Ramban stayed on security grounds | | Court issues notice to Govt | | EARLY TIMES REPORT JAMMU, Nov 19: Justice Mansoor Ahmed Mir in a petition filed by Umar Jan Sr. Asst in the Social Welfare Dept, nephew of Former Chief Minister Ghulam Nabi Azad, has issued notice to State of J&K though Financial Commissioner (Home), Principal Secretary Social Welfare, Director Social Welfare Jammu and Under Secretary Social Welfare returnable within four weeks and after hearing Adv AM Malik appearing for the petitioner directed, status-quo be maintained till next date of hearing. In the petition it has been submitted that the petitioner due to threat perception at the hands of anti-national elements was attached in the directorate of Social Welfare Jammu along with post. The petitioner is a nephew of ex-chief minister Mr. Ghulam Nabi Azad. According to the intelligence agencies that all the family members of Mr. Azad have threat perception. The petitioner is also having threat perception and in view of the threat perception the police had provided one PSO to the petitioner as he has been designated as a "protective person" due to family's political background. The petitioner seeking quashment of GAD order 975/2008 dated July 17, 2008. Qua the petitioner and subsequently another order dated October 22, 2008 issued by under secretary to the Govt Social Welfare Dept whereby the petitioner was directed to report Social Welfare Officer Ramban immediately despite threat perception. It is further submitted that the petitioner made a representation to Director Social Welfare Jammu, the Director Social Welfare made a communication on September 29, 2008 to Principal Secretary Social Welfare Dept whereby it was submitted by the Director has made a representation of his adjustment in Jammu District because of the threat perception from militant organizations as the petitioner is a real nephew of former chief minister of J&K. The Director Social Welfare Jammu further requested for the issuance of necessary orders in the light of report of the police agency. It is further submitted by the petitioner was that the matter was under consideration but the under secretary in hush-hush manner illegally/arbitrarily made a communication to the Director Social Welfare whereby the petitioner was directed to report to District Social Welfare Officer Ramban immediately, failing which the petitioner shall be placed under suspension. On this grounds, petitioner file this petition and seeking quashment of orders. Court after hearing counsel for the petitioner ordered status-quo be maintained till next date of hearing. JNF |
