Four Police officers wanted to stall probe: Govt admits

JAMMU, Nov 19: Even as the Model Code of Conduct is coming in the way of implementing government’s decision with Shri Amarnath Yatra Sangharsh Samiti –which spearheaded two-month long agitation in Jammu –the government has termed the allegations of four Police Officers against Justice OP Sharma Commission of inquiry as ‘vague, misconceived and motivated’
Meanwhile, the SAYSS today had a meeting with Governor’s Advisor Dr SS Bloeria to discuss progress on implementation of August 31 agreement. The government informed that the Samiti members that out of 390 cases registered against those involved in violence and arson during agitation 196 have been withdrawn and remaining are being examined by the Home Department.
Justice Sharma’s one man Commission of inquiry was probing the alleged disrespect to body of Kuldeep Kumar Verma who had died following an alleged suicide at the venue where Shri Amarnath Yatra Sangharsh Samiti was on hunger strike on July 27. Four police officers - Swatantar Arora, SDPO City (North), Mohan Lal Kaith, DSP, Alok Kumar, SSP (IPS) and Shalinder Singh, SP –had written to the Law department casting aspersions on neutrality of the inquiry commissioner. Following this the inquiry commissioner suspended further work on case pending response from the government. This has enraged the SAYSS but the government today clarified that inquiry will go on by same commissioner as allegations were not found correct.
An official spokesman said today that the Commission of Inquiry, appointed by the Government to enquire into the cause which led to the death/suicide of Kuldeep Kumar at hunger strike, venue of Shri Amarnath Yatra Sangharsh Samiti, Parade Ground, Jammu on July, shall proceed further in the enquiry and complete the same within the stipulated period.
A Government Order issued by the Law Department today says that the Inquiry Commission appointed vide notification SRO 218 dated 28-07-2008 had initiated the enquiry proceedings and recorded statement of some of the witnesses. During the course of proceedings, some of the police officers namely, Swatantar Arora, SDPO City (North), Mohan Lal Kaith, DSP, Alok Kumar, SSP (IPS) and Shalinder Singh, SP, who have been put to notice under the Act, filed applications for stay of further proceedings on the ground that they have represented to the Government for change of Presiding Officer of the Commission.
The Commission, vide its order dated 31-10-2008, stayed the proceedings until the applications referred to above are disposed off by the Government.
The Government received the representations of the four police officers alleging bias on the part of the Presiding Officer, therefore, requesting for change of the Presiding Officer of the Commission of Inquiry.
The Government examined and considered the representations and upon such consideration, found that the allegations leveled were vague, misconceived and motivated with a design to stall the proceedings of the Commission. Accordingly, the representations were rejected and asked the Commission to proceed further in the enquiry and complete the same within the stipulated period of time.
