| Court declines directions for uninterrupted power supply | | | EARLY TIMES REPORT JAMMU, Nov 21: Division Bench of J&K High Court Jammu Wing comprising Justice Nisar Ahmed Kakru Acting Chief Justice and Justice YP Nargotra today decided much publicized PIL titled Association of Self-Help and Awareness, M/S JK Flour Mills, Devinder Mahajan and M/s Kashmir Hotel & Restaurants Association. Regarding the PIL filed by Association of Self-Help Awareness, Division Bench observed that the PIL seeking direction to the respondents to provide uninterrupted power supply to the consumers, observed that in totality of the circumstances, it emerges that the actual demand of power is much more than the registered consumer demanded suggesting over consumption of power making curtailments imperative thus direction to do away with curtailments is declined. Regarding the Special Treatment extended to VIPs by supply of power from special feeder, Division Bench said that being the turmoil state it is not a secret that the state has witnessed so many casualties of politicians, civilians and officers including a District and Sessions Judge. In that view of the matter it is too much on the part of the petitioner to advance a claim to be treated alike those whose lives are faced with danger and declined to issue direction. Regarding the illegal connections, Court observed that in view of the overall consideration of the matter, DB is of the considered opinion that this petition has outlived its life. Regarding concern of Sr. Adv UK Jalali that the proceedings in the petition should continue so that directions those may become necessary from time to time are passed. Upon this DB said that such course if conceded too may amount to assuming the power of administration of electric department which the DB declined being uncalled for a law. With these observations DB disposed off this PIL. Regarding the PIL filed by Devinder Mahajan seeking uninterrupted power supply, DB referred the order passed in PIL filed by Association of Self-Help Awareness and dismissed the petition. JNF |
