Court awards 3 years RI, fine of Rs 5000 in sexual assault case

JAMMU, Feb 26: Presiding Officer Fast Track Court, POCSO Balbir L. Jaswal today awarded three years imprisonment and fine Rs 3000 to Parmodh Sethi in sexual assault with minor.
Presiding Officer Fast Track Court, POCSO Balbir L. Jaswal after hearing Advocate Vinod Saini for the accused whereas APP Suresh Sharma for the UT observed that the contents of the FIR registered against the accused depicts that accused has touched the victim inappropriately, caught hold her and touched her cheeks. The statement recorded by the victim before the court in her statement she has testified that accused has touched her cheeks and put his arm on breasts and in another washroom accused pulled her from waist and these facts remained unrebutted in the statement of the victim attracts the section 7 of the POCSO Act. Since the accused has touched the breast of victim. The offence under section 7 of POCSO Act is identical with the offence of 354 IPC. It also carried the punishment upto 05 years an fine. The punishment in higher is always followed. The confession of the charges itself get the accused as convicted.
The prosecution has presented the charge sheet averring therein that on dated 10.08.2019, the above named accused was engaged by the PW-1 for repairing the wash rooms. When the work was over, the accused called the complainant to check the showers. The complainant sent the victim to check the showers. When the victim went inside the washroom, the accused caught hold her, touched her cheeks and put his hand on thigh. The act of the accused was apprised to the complainant, who lodged the report with the police station, Nowabad. The accused was arrested and after completion of the investigation, this charge sheet was presented on 30.08.2019. —JNF
