| Court summons Forest Secretary | | | EARLY TIMES REPORT
JAMMU, Nov 26: Justice Mansoor Ahmed Mir of J&K High Court Jammu Wing in a petition filed by GD Chalotra IFS, has granted one weeks time to file compliance report in terms of order October 21, 2008 (whereby Court directed Chief Secretary to adjust the petitioner against the cadre post), in default Commissioner/ Secretary Forest Dept, shall appear in person before the Court on the next date of hearing.
The petitioner submitted that being an IFS officer he was posted as DFO Social Forestry Division Kathua and later his services were placed at the disposal of Director EE&RS Department for further posting and in his place Subash Chander Sharma was posted as Incharge Divisional Forest Officer. During the course of argument Adv SK Anand appearing for the petitioner submitted that private respondent No 4 cannot be posted as DFO Social Forestry as he has not been inducted into the Cadre post in terms of IFS (Cadre) rules1966, "Cadre Post" means any of the posts specified under Item I of each cadre in the scheduled to the IFS. Court after hearing, on October 21, 2008, had directed Chief Secretary to adjust the petitioner against cadre post and posting of respondent No 4 shall also be made strictly in accordance with the rules. Court had also directed Chief Secretary that he shall consider the case of the petitioner as well as respondent No 4 within one week. Despite this order, the respondent has not adjusted the petitioner against the cadre post, Anand argued.
Court after considering the case of the petitioner directed respondents to file compliance report and in default Commissioner/Secretary Forest Department shall appear in person. JNF |
