| One booked for attempt to cheat court | | | EARLY TIMES REPORT JAMMU, Nov 26: On the direction of Chief Judicial Magistrate Kathua M. R Chak, Kathua police today registered a case u/s 468/467/471 and 420 RPC against Gian Chand son of Nanak Chand resident of Ward No 12 Kathua, for attempting to cheat the Court for registration of sale deed by tempering the documents. Gian Chand presented two sale deeds for registration as attorney on behalf of owners of the land namely Om Parkash son of Nand Lal resident of Ward No 6 Kathua in respect of land measuring one Kanal 10 Marlas and one Kanal falling under Khasra No 1268 Min situated at Tajwal Tehsil and District Kathua in favour of Balbir Singh and Ors. The CJM after perusing the deed of power of attorney dated November 4, 1996, observed that Khasra No mentioned in the deed has been tempered with and instead of Khasra No 1265; Khasra No 1268 has been shown. Court noticed that attorney has been authorized to alienate the land falling under Khasra No 1265 only and not under Khasra No 1268 as is shown in the deed of power of attorney and as such the alleged accused has committed forgery for the purpose of cheating and has that way transgressed his power as attorney on behalf of owner of land and as such is liable to be prosecuted under law. After considering all the facts, Court directed police to register case and investigate the matter under law. The police registered case under FIR 325/2008 and started investigation in the case.
