| Cop involved in minor’s rape gets 10 yrs RI | | | EARLY TIMES REPORT
Poonch, Nov 28: Principal Sessions Judge Poonch, GK Pandita today awarded 10 years rigorous imprisonment and fine of Rs 7000 to accused Mukhtiar Ahmed, a police cop facing trial in a minor's rape case.
After hearing Public Prosecutor Showkat Amin Manhas appearing for the state and Advocate Mohinder Pyasa appearing for the accused and considering the background of the case, Principal Sessions Judge observed that the convict being a commando in police department has shown his expected reflexes not in protecting the honour of a minor girl but in lifting the girl in broad day light from Mendhar bazar in a Sumo where he exploited his sexual lust and thus stigmatized not only the victim but her whole family for years to come. The act of the convict has left an indelible scar both on the victim and her family. The victim at the time of occurrence was unmarried and had unmarried sister and brother. The convict is not an ordinary citizen but a police cop who is meant to protect the dignity, honour and rights of the civilians in general and particular of the feminine gender. The accused by his act has brought shame and disrespect to the institution to which he belongs. With these observations Court awarded 10 years RI and fine Rs 7000 to the accused with the direction that the payment of fine, in case accused opts for payment, Rs 5000 to be paid to the victim. JNF
According to the prosecution case the victim, while strolling near the Dak Bunglow on February 6, 2006 along with her minor sisters and brothers, the accused Mukhtar Ahmed in police uniform suddenly appeared before them in a Sumo and threatened all of them on gun point to board the Sumo which they boarded on threat. It was alleged that the Sumo drove towards village Kota Mendhar and when it reached at a culvert the vehicle was stopped on the direction of accused. The accused is alleged to have confined the minor sister and brothers of the prosecutrix in the sumo while he dragged the prosecutrix and took her under the culvert where he committed rape upon her. The prosecutrix told the story to her mother; the mother lodged a written complaint with the police. The case was registered u/s 376 RPC. After the medical examination of the prosecutrix the police arrested the accused Mukhtiar Ahmed, working as a commando, and after completion of the investigation presented the challan which was committed to Sessions Court for trial of the case. |
