| Court awards 12 years RI to two charas smugglers | | | EARLY TIMES REPORT Ramban, Nov 28- Principal Sessions Judge Ramban, RS Jain today awarded 12 years rigorous imprisonment and fine Rs 2 lakhs each to accused Ali Mohammed son of Bashir Ahmed resident of Bangund, Qazigund and Mukhtiar Ahmed son of Abdul Aziz r of Charath Qazigund Kashmir, driver and conductor of a truck respectively, for carrying Charas weighing 8 kg 700gram from Kashmir to Jammu. Principal Sessions Judge, after hearing Public Prosecutor Abdul Hamid appearing for the state and counsel for the accused( present in the court under custody) and going through the case diary, observed that NDPS Act has been enacted to make stringent provisions for the control and regulation NDPS and to curb the trade of illegal drugs. Offences under NDPS Act are grave in nature and a menace to public and society, dealing lightly with such offences would have serious effect and consequence and the law under the NDPS Act has been enacted to make it stringent upon the persons involved in illicit drug trafficking and referred a judgment of the Supreme Court and held that the facts as proved in the present case are that the accused persons were consciously transporting commercial quantity of charas. The drug menace in the J&K is increasing day by day and completely destroying the fiber of the society and its youth thereby calling for severe punishment in case of illegal transportation of drugs meant for illicit trade. With these observations, Court awarded 12 years rigorous imprisonment to both the accused along with Rs 2 lakh each as fine. JNF |
