| Court rejects bail of senior citizen in POCSO ACT | | | Early Times Report
JAMMU, May 5: Principal Sessions Judge Reasi R N Wattal has rejected the bail application of one Saiyan, aged 77 years who was arrested by the police in FIR NO 71/2021 U/S 341,376,511 of IPC & 8 POCSO Act.
While rejecting the bail application, Principal Sessions Judge Reasi observed that on perusal of charge sheet that on 10-9-2021 complainant in the company of her daughter namely Maqsooda Bano moved a written application before the SHO P/S concerned with the averments that complainant had gone to Srinagar for labour work and when he returned her daughter told him that on 31-8-2021 when she went to bring the grass for cattle near Soli Nallah the accused tried to rape her.
The complainant said that her daughter saved herself from the clutches of the accused and also videographed the incident and FIR 71/2021 for the commission of offences 341,376,511 of IPC was registered against the accused. The investigating officer got the statement as prosecutrix recorded before the Magistrate u/s 164-A of Cr PC, collected the school going certificate of the prosecutrix and concluded the investigation.
The court said that the modesty of a minor girl is alleged to have been outraged by the petitioner, in habitants of the area are in a state of shock when heard about the attempt to rape of a minor prosecutrix by his accused. Any concession of bail in favour of the petitioner shattered the faith that a common man has got in this prestigious institution. |
