| NCB’s IO gets clean chit | | | EARLY TIMES REPORT JAMMU, Dec 3: Acquitting Ravi Koul, Intelligence officer Narcotic Control Bureau (NCB), who was caught red handed while taking illegal gratification in consideration of making case weak facilitating release of Narinder, who was arrested in drug trafficking case on December 24,2005, Special Judge Anticorruption Jammu BL Bhat after hearing the arguments and witnesses observed that on appreciation of evidence adduced by the prosecution at the trial it can safely be held that the prosecution has failed to establish nexus between the accused and guilt alleged against them. Investigation does not appear to have been conducted in a fair and transparent manner. Prosecution evidence fails to inspire confidence and the trap appears to have been motivated. The evidence adduced by the prosecution is not qualitative, consistent, reliable, confidence inspiring and worthy of faith being repose therein. The legal proof in respect of complicity accused Ravi Koul demanding and accepting bribe from complainant by himself or through accused Vinay Kokkar is lacking. No presumption regarding gratification can be drawn in these circumstances. The case is accordingly dismissed and the accused are acquitted of the charges framed against them. JNF |
