Court sentenced Two years to accused involved in kidnapping of minor Girl

Jammu, September, 15:- Second Additional Session Judge Jammu Mr. AK Koul today awarded two year imprisonment and fine of Rs 1000/- to accused Sham Lal alias Shnu r/o Badri Nagar, Prithipur Bishnah u/s 363 RPC.



According to the prosecution story on January 14, 2003, the mother of prosecutrix lodged a complaint with P/S Gangyal alleging therein that her daughter aged about 16 years used to attend classes at Kunjwani for two years daily from 4:00 PM, to learn tailoring. She went missing since January 9, 2003, a hectic search was launched but prosecutrix could not be located. Now it has been learned that Sham Lal Alias Shnu had kidnapped her. On this information a case u/s 363 RPC was registered and on specific clue recovered the prosecutrix from the captivity of the accused and she was produced before Additional Munsiff Jammu, where her statement was recorded and on this statement, the offences changed u/s 363/376 RPC.



Mr. AK Koul Second Additional Sessions Judge Jammu after hearing Mr. Ravinder Sharma Additional Public Prosecutor and Advocate Deepali Arora appearing for the accused and also gone through the police dairy and medical report held that the case u/s 376 is not made out and the accused is squarely liable for commission of offence u/s 363 RPC. Keeping in view all the facts and circumstances the Court feels that a lesser punishment would even serve the ends of justice, so while convicting accused u/s 363 RPC, sentenced him to imprisonment of two years and fine of Rs 1000/-.
