CJM directs SHOs, I/C PPs to mention date of arrest in report

JAMMU, Aug 10: Taking serious note for not mentioning the date of arrest in the police reports submitted to court, Chief Judicial Magistrate Jammu Amarjit Singh Langeh directed all the SHO(s) and Incharge(s) of Police Post (s) in the District would be made aware that whenever they submit a police report in a bail matter, they should categorically and without mistake mention date of arrest of accused if any made.
CJM Jammu Amarjit Singh Langeh further ordered that a copy of this order shall go to SSP, Jammu for information and follow up action through prosecution. This significant order has been passed in bail applicaton filed byHarish Babbar , Naresh Kumar Chhabra , Munish Gupta and Gourav Gupta seek release on bail.
CJM Jammu observed that as a matter of record this application was presented on 06.08.2022 when report from SHO concerned was directed to be called. Said report has been received from Police Post Greater Kailash today. It is placed on record and in terms of police report, petitioners were taken into custody under section 41 of Cr.P.C in FIR no. 27/2022 for offence under section 379 of IPC. Throughout the police report, date of arrest of petitioners has not been mentioned. Police report also indicates that since no incriminating evidence could be collected against petitioners, they, therefore, have been exonerated under section 169 of Cr.P.C and thus petitioners stand released from custody.
During this proceedings, CJM Jammu observed that it has been invariably noticed that in most of the police reports date of arrest is not been mentioned. This omission has consequences and directed all the SHO(s) and Incharge(s) of Police Post (s) in the District would be made aware that whenever they submit a police report in a bail matter, they should categorically and without mistake mention date of arrest of accused if any made.
