| Panchbakhtar Temple land | | HC restrains Mahant from entering into any deal | | EarLY Times Report Jammu, Dec12-Jammu and Kashmir High Court today restrained Mahant Prabodh Anand Bairaagi from entering into any deal for the disposal of the property of the Shivalaya Panchbakhtar temple.
Justice Sunil Hali in a much publicized property case of Shivalaya Panchbakhtar, directed Mahant Prabodh Anand Bairaagi that he shall not be allowed in any manner to deal with the property of temple nor will he be permitted to execute sale or transfer of the property or execution of power of attorney in respect of the property of the temple. Court also ordered that the power of attorney executed by Mahant Prabodh Anand Bairaagi in favour of Ashok Kumar Jogi (PDP leader) and any subsequent deed executed by the said attorney holder shall not be given effect to and same shall be kept in abeyance and not be acted upon.
Justice Hali, after hearing Senior Advocate UK Jalali assisted by Neha Bakshi and Shivani Jalali, advocates appearing for the applicants Panchdashnaam Zoona Akhada and Ors and Senior Advocate AV Gupta assisted by Advocate YE Tak appearing for the Prabodh Anand Bairaagi, observed that it is also brought to the notice of the court that an FIR stands registered against Prabodh Anand Bairaagi for having executed power of attorney in favour of one Ashok Kumar Jogi in respect of the property belonging to Shivalaya Panchbakhtar Temple with an intent to dispose off the same. The police have already initiated investigation in the matter and said Mahant is under police custody. Serious allegations of misconduct, mismanagement and misuse of funds in running the affairs of the temple have been leveled against the respondents in this application.
Court asked Registrar Judicial High Court Jammu Wing Suresh Sharma that he shall, during interim period, manage the affairs of the temple and submit status report regarding actual rent received from property of the temple to this Court and he is also authorized to receive rent from the tenants. He shall take such other steps which are necessary for running the affairs of the temple. Court held that this order has been passed keeping in view the fact that there are serious charges against Mahant Prabodh Anand Bairaagi in respect of running the affairs of the property of temple. Registrar Judicial shall be at liberty to seek assistance of the police in this respect, if need arises, the Court ordered.
