| Seven months term for rash driving | | | EARLY TIMES REPORT Jammu, Dec13- Chief Judicial Magistrate Jammu YP Bourney has awarded sentence and fine to auto driver Mahinder Singh driver of an auto who on January 14, 2003 rashly and negligently driving hit a girl namely Mannu Singh daughter of Azad Singh causing her grievous injuries. After committing the accident accused fled away leaving the vehicle on spot. CJM, after hearing CPO MA Manhas for the state and goning through the statement of witnesses produced by the prosecution, observed that it has been established beyond doubt that accused was driving the offending auto rashly and negligently when it hit Mannu Singh and caused grievous injuries to her. The identity of the accused driver of vehicle is established from the evidence of Mannu Singh who had no motive to implicate the accused falsely. The statement of the injured appears to be natural as accident is always an accident and there is no material in consistency in the statements of prosecution witnesses, therefore, prosecution has been successful in establishing its allegations against the accused beyond any shadow of doubt. With these observations Court awarded 6 months imprisonment for offence u/s 338 RPC and one month for offence u/s 279 RPC and fine Rs 1000 and 2000 respectively. Court further said that entire amount of fine if realized shall be paid to the injured as compensation. JNF |
