DB directs CEO Sonamarg to appear in person for explaining development work

JAMMU, Oct 7: In a Public Interest Litigation regarding preservation of Sonamarg, A Division Bench Jammu & Kashmir and Ladakh High Court Comprising Chief Justice Pankaj Mithal and Justice Moksha Khajuria Kazmi direct the Chief Executive Officer, Sonamarg to appear in person on the next date to explain the development work he intends to carry out at Sonamarg and how he is planning to preserve the meadows and Glacier.
When the PIL came-up for hearing, DB observed that in pursuance to the order dated August 5, 2022 requiring the Chief Executive Officer, Sonamarg Development Authority to explore the possibility of using wooden fence, hedges and plantation of trees to demarcate the various meadows and the boundaries of the various properties, an affidavit of the Chief Executive Officer, Sonamarg dated 01.09.2022 has been filed bringing on record the master plan for the year 2005 to 2015 and alleging that the master plan for the year 2025 to 2040 is under process of being framed by the Chief Town Planner.
DB observed that in regard to CM No. 5691/2021 Deputy Commissioner, Baramulla was directed to file response. The said application was filed so as to seek permission for construction of indoor swimming pool, gymnasium and Spa in the Hotel Snowland at Sonamarg. It is stated that the matter is being referred to the BOCA but till date there appears to be no final order either allowing or rejecting building permission to the said applicant-Farooq Ahmad Hafiz.
DB grants Govt Advocate grants two weeks time to inform the court as to the exact position of the application of the applicant dated 16.07.2021 seeking building permission.
DB directed to file necessary instructions in the matter and file fresh affidavit especially regarding application No.5691/2021. —JNF
