Child theft case: CJM Kishtwar rejects bail of accused woman

Jammu, Oct 13: Chief Judicial Magistrate Kishtwar Y P Sharma rejected the bail application of a woman, Shabnum Bano, prime accused in child theft case in Kishtwar district.
As per the details available with Early Times, the bail application was moved by Advocate Safdar Ali for petitioner while APP Sheikh Mansoor Ahmed opposed the bail application of the accused.
The CJM Kishtwar while rejecting the bail plea stated: “The case against the petitioner is very serious and of heinous in nature, the allegations against the applicant are well founded which are based upon the scientific evidence. The recovery of the kidnapped child has been affected from the possession of petitioner from her house/room. The petitioner was not supposed to have the child of some other person for more than 7 hours of its kidnapping which clearly suggest her criminal intention although during this time the whole town was under deep shock due to this incident and everyone was running to ensure safety of their children because of latest social-media viral videos showing child lifting gang in action. The petitioner cannot at this stage of the investigation claim innocence because there is sufficient material on the record to connect her with the crime allegedly committed in the case and this case appears to be of large magnitude.” “Accordingly, for the foregoing reasons and keeping in mind the large interest of society; the seriousness of offence and allegations against the petitioner, the offence being against society and punishable with life imprisonment, the manner in which the offences committed, the scientific evidence against the petitioner showing her involvement collected by the IO. The present petitioner, who although is a woman, but in the considered opinion of the Court does not deserve judicial discretion of bail when all the facts and circumstances/material on record are seen in totality. Hence, bail application is rejected, the CD file be returned to the IO.” The CJM Kishtwar stated while rejecting the bail application.
