Jammu, Dec18 Additional Sessions Judge Jammu MA Choudhary today rejected the bail application of Darshan Lal son of Tara Chand, father of two children, who allegedly committed rape upon mother of four children. While rejecting the bail application, Additional Sessions Judge observed that the applicant has been accused of an offence which is punishable with imprisonment for life or imprisonment for 10 years and fine. The accused is thus alleged to have committed a grave and heinous offence as the offence of rape not only effect the persons but tramples her sole as well and the memories of this horrible offence shall continue to hunt her whole of her life. With these observations Court dismissed the bail application. According to the police case, prosecutrix on November 3, 2008 made a written complaint with the police alleging that on November 2, 2008 at about 4:00 PM while she had gone in the field for the call of nature, Darshan resident of Nagrota Tehsil caught hold her and took her to nearby bushes where he raped her. On this, the police registered a case u/s 376 RPC and during the investigation, the statement of prosecutrix was also got recorded u/s 164-A Cr PC before the Judicial Magistrate. From the investigation it was proved that the accused had committed offence punishable u/s 376 RPC and accordingly the accused was taken into custody on November 11 last. Counsel for the petitioner Adv VK Gupta seeking bail of the accused on the ground that Jajjar Kotli police has registered a false and frivolous case against the petitioner, who is under detention for last one month without any justification. He also submitted that the lady, who is mother of four children, has lodged a report against the person who is married person having two children at the behest of interested persons and under police pressure. Additional Public Prosecutor VK Sharma appearing for the state filed detailed objections asserting that the accused was involved in a commission of serious and heinous offence of rape, punishable with life-imprisonment, the accused, if granted bail, may jump over and pressurize the prosecutrix especially and thus seeking dismissal of the application.
