HC dismisses petition filed from Tihar jail

Jammu, Dec 22-Treating a petition as habeas corpus filed by Kuldeep confined in Tihar seeking direction to the respondents for finding out the whereabouts of his father Romesh reportedly missing since May last, Justice Virender Singh of J&K High Court Jammu Wing after hearing Additional Advocate General VK Chopra appearing for the state disposed off the petition with the observation that nothing survives in this petition and same is disposed off accordingly.
Justice Singh further observed that the petitioner had also referred the missing report to another police station Rajbagh and the SHO of the said police station was also directed to submit his report. Now after verifying all the facts, an affidavit has been tendered by Kuljeet Singh SHO Police station Hira Nagar submitting therein that father of the applicant Romesh Chander in December 2007 met Sham Singh alias Shama of Khour Camp Tehsil Akhnoor and had some conversation and went back. On the next date Romesh Chander had left the house without telling his family and thereafter his whereabouts were unknown. However, during the investigation, it was known that Romesh Chander, indulged himself in smuggling and the deponent Romesh Chander had been arrested in connection with the smuggling activities about 14/15 years earlier by the customs department and remained in the Hira Nagar Jail as a convict. After two and half year's conviction he was released but was again arrested by the police, he was again convicted and confined in Jammu central jail and was released after undergoing his sentence. He was in contact with smugglers of Punjab and his main activities were smuggling and he used to remain absent from his house. This information has been supplied by the brother of Kuldeep namely Parmanand. It was also revealed that Kuldeep at present is jailed at Tihar Jail Delhi and his father Romesh Chander is jailed at Amritsar. A fax message sent to Superintent Jail Amritsar has been duly acknowledged by him and relevant information shall be forthcoming shortly. The SHO Hiranagar is making all out efforts to confirm whether the father of the petitioner Romesh Chander is at Amritsar Jail and as and when the required information is made available by the authorities, the same can submitted before the High Court.
