| HC imposes cost Rs 5000 to CBI seeking adjournment | | | Early Times Report Jammu, Dec 22- Justice JP Singh of J&K High Court Jammu wing in a petition allowed another adjournment to the CBI to make appropriate arrangements for the prosecution of the condonation application and criminal acquittal appeal, this shall, however, be subject to payment of Rs 5000 as costs. This significant order was passed by Justice JP Singh in a case of condonation of delay in which the Court had heard Adv Navneet Dubey for the applicant and Advocate General DC Raina for the state of J&K. Advocate Navneet Dubey appearing for the applicant CBI sought adjournment on the ground that some senior counsel had in fact been asked to argue the matter. Upon this, the Court took serious note and further observed, had the counsel for the CBI any such instructions from his client, he could well have made this request at the time when the case was taken up for consideration. No such request was however, made and counsel took chance to argue the matter. On finding that he was unable to deal with the case, he had sought adjournment. While deprecating the practice of making such type of request to seek adjournment in midst of arguments, court is of the view that as important question have been raised in the case so it would be appropriate to allow another adjournment to the CBI to make appropriate arguments for the prosecution of the condonation and criminal acquittal appeal. This shall, however, be subject that payment of Rs 5000 as costs, Court ordered. JNF
