| Adjustments of Head Assistants at HC stayed | | | Early Times Report Jammu, Dec 23- Justice JP Singh of J&K High Court Jammu wing, in a petition filed by Rajesh Kumar & Ors seeking issuance of directions and quashing order No 667 dated November 24, 2008 of the High Court of J&K in so far it adjusted number of Head Assistants in their own pay and grade, today stayed the operation of the order in so far as it provides for adjustment of private respondents as Head Assistants. Justice Singh in his significant order, after considering the submissions of both sides and perusing the J&K High Court Staff (condition of service) Rules 1968 as also order No 579 of October 24, 2008, observed that although the arrangement devised by the High Court for adjustment of respondents as Head Assistants may not amount to their promotion as such yet their consideration for adjustment against these posts becomes prima-facie unsustainable as only such persons may be considered even for adjustment against a higher post, who are otherwise eligible for the promotional post. Justice Singh further observed that a case for admission and issuance of interim directions has been made out and issued notice to the respondents and ordered that till further orders from this Court operation of order NO 667 dated November 24, 2008 issued by the Registrar General High Court of J&K in so far as it provides for adjustment of private respondents as Head Assistants shall remain stayed. Court however clarified that respondents shall, however, enjoys liberty to make motion for vacation/modification of this order. JNF
