| HC quashes detention of LeT terrorist under PSA | | | Early Times Report Jammu, Dec 30- Quashing the detention of Mohammed Taj son of Mohammed Hussain Gujjar resident of Chak Banola Mendhar, who was detained under Public Safety Act by the order District Magistrate Jammu on November 21, 2007, Justice J P Singh of Jammu and Kashmir High Court today directed the respondents to set the petitioner to liberty, if not required in any other case. While allowing the habeas corpus petition, Justice Singh, after hearing Advocate Rajneesh Oswal appearing for the petitioner and Additional Advocate General VK Chopra appearing for the state, observed that the records produced by the state counsel do not indicate as to why the detention order issued on November 21, 2007 had not been executed for more than three months and the ground of detention, on which petitioner has been detained, too do not indicate any such activity of the petitioner. Court is of the opinion that the detention order issued by District Magistrate Jammu for the detention of petitioner suffers from non application of mind and is even otherwise unjustified. With these observations, Court allowed the petition and quashed the order of District Magistrate Jammu dated November 21, 2007, whereby the petitioner was detained under PSA, with the directions to the respondents to set the petitioner to liberty if not required in any case. The petitioner was detained under PSA on the charges of his being the upper ground worker of Lashker-e-Toiba and involved in a case of attempt to lob the grenade and recovery of a grenade on his instance from the under construction house in Bilal colony on June 15,2007.
