LPA disposed off

Jammu, Jan 1: Four months after agreement between Government and Amarnath Yatra Sangharsh Samiti, a Division Bench of Jammu and Kashmir High Court has disposed an LPA on allotment of land to Shri Amarnath Shrine Board.
Disposing off the LPA filed by the state government against the order of the Single Judge in a much publicized allotment of land to Shri Amarnath Shrine Board, a Division Bench of J&K High Court, comprising Justice YP Nargotra and Justice Vinod Kumar Gupta, today observed that the both the parties have agreed to the disposal off appeal on the terms indicated in LPA, as they have already reached to an agreement on the issue.
An application was filed on behalf of Shri Amarnath Shrine Board for seeking settlement of appeal in terms of the agreement arrived at between the Government and Shri Amarnath Yatra Sangarsh Samiti by a Government order dated September 25, 2008. In response to this application the State through Advocate General DC Raina has filed a communication NO LD (Lit) 2004/103-GAD Dated December 22, 2008 from Special Secretary to Government Law Department addressed to the Advocate General which reads that ‘in case the LPA is listed before the Court, state may agree for its disposal in the following terms". " LPA is disposed off as settled in terms of the agreement arrived at between the Government and Shri Amarnath Yatra Sangarsh Samiti to the extent the agreement pertains to the matter under adjucation and the judgment/direction of the Single Judge dated April 15, 2005 shall stand modified accordingly".
Division Bench, after hearing Advocate General DC Raina with Adv MA Bhat for the state, Sr. Adv UK Jalali with Adv P Sethi for the Shrine Board and Advocates LK Sharma and Inderjeet Gupta for respondent N0 1 Ram Pal Bathonia and VK Magoo ASGI for Union of India, and also going through the communication, observed that both the parties have accepted the contents of the communication and agreed to the disposal of the appeal. In token of acceptance of such settlement, this communication has been signed by Advocate General DC Raina on behalf of appellant, M/s LK Sharma, Inderjeet Gupta Advocates on behalf of respondent No 1 and UK Jalali Sr. Adv on behalf of respondent NO 2 and 3, and VK Magoo ASGI one behalf of Union of India, the Division Bench observed and accordingly disposed off the LPA.
