| Gopal Arya Mission property auction case | | DB directs for completion of process | | Early Times Reporter Jammu, Jan O2- In a much publicized multi crore finance scam allegedly committed by Gopal Arya Mission, the Division Bench of J&K High Court, comprising Justice YP Nargotra and Justice Vinod Kumar Gupta, has directed the Receiver and Joint Receiver to be in contact with the Divisional Commissioner Jammu to facilitate his inspection of the said property on the date to be mutually agreed upon them. This direction has been passed in PIL as the High Court had ordered on December 12, 2008 that Advocate General DC Raina should take-up the issue with the Government regarding the possibility of purchasing the Gopal Bhawan either by the Government or by any of its instrumentalities. Advocate General pursuant to the court direction took up the case with the government and the Divisional Commissioner Jammu was asked to have on spot assessment of the property. He further submitted that so far the Divisional Commissioner has not been able to inspect the said property, the same being under the lock and key of the Receiver and sought directions to the Receiver to be in touch with the Divisional Commissioner and to provide him an opportunity of inspecting the said property. The property of Gopal Arya Mission was put to auction by the Receiver and in response to which Rajinder Tickoo presently DG Prisons offered a bid of RS.9.50 lakhs and had already submitted a CDR of Rs.50, 000. However, Senior Adv PS Dutta with Adv VK Magoo representing Subash Chander son of Madan Mohan resident of Kacchi Chowni Jammu submitted that their client is interested to purchase the said property and is ready to offer a price of Rs 10 lakhs and in fact they have a cheque of the said amount in their possession. The offer made at the Bar by Senior Adv PS Dutta and Adv Magoo is admittedly higher than one given by Rajinder Tickoo, the court observed. The Division Bench is of the view it will be appropriate if Rajinder Tickoo is put on notice informing him about the bid of said Subash Chander so as to enable him to increase his bid if so desires. The Joint Receiver submitted that a written communication from Rajinder Tickoo addressed to Advocate General has been received by him, in which he has declined to enhance his bid from Rs 9.50 lakhs. In such a situation according to Shakeel, the offer of Rs 10 lakhs made on behalf of Subash Chander may be allowed to be accepted. The same being in tune with the market value, Counsel for the parties including the court counsel is in agreement with Joint Receiver. Upon this Division Bench directed Receiver/ Joint Receiver to complete the process of acceptance of offer made on behalf of Subash Chander which after his formal acceptance shall stand approved/ confirmed by the Court.
