File status report about framing of water policy: HC to senior AAG

JAMMU, Feb 14: In a contempt petition in which the grievance of the petitioners is with regard to the illegal construction being raised on Kunjwani Talab situated in village Deelli, Jammu, a Division Bench of Jammu & Kashmir and Ladakh High Court comprising Justice Sanjeev Kumar and Justice Puneet Gupta observed that from the compliance reports filed by the respondents and the revenue documents placed on record, it is evident that the commercial complex of respondent No. 3 is on Khasra Nos. 383 and 384 in Village Deelli, Tehsil-Jammu whereas the water body is primarily located in Khasra No. 382.
The DB vide order dated 20.12.2022 had directed advocate Vikas Magotra counsel appearing for the petitioners to place on record the relevant revenue record to demonstrate that Khasra Nos. 383 and 384 are also water bodies but he has failed to do so. However, he prays for and is granted last and final opportunity of four weeks to do the needful, if he so desires, in terms of order dated 20.12.2023, the Division Bench said.
The DB also directed Monika Kohli, Sr. AAG appearing for the respondents shall file fresh status report indicating as to how the directions passed by this Court to frame that State Water Policy and plan/scheme in terms of Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010 in WPPIL No.
CPOWP No. 203/2016 in APOWP No. 41/2016 19/2014 and WPPIL No. 20/2013 titled Balbir Singh V/s State of J&K and Ors have been implemented. The complete compliance of the directions contained in para 25 of the judgment dated 12.02.2016 shall be reported by the next date. —JNF
