| Regularization of ARTO, HC declines interim relief | | | Early Times Report
Jammu, Jan O6- In a petition filed by Bhumesh Sharma seeking regularization as ARTO from January 31, 2001 and induction into KAS and also seeking direction to State respondents not to accord consideration to respondent Ashwani Khajuria ARTO for induction into KAS, Justice JP Singh of Jammu and Kashmir High Court has declined interim relief as prayed for by the petitioner and directed the registry to list SWP No 1248/2008 after vacation. Justice Singh, after hearing Sr. Adv ZA Shah appearing for the petitioner, Additional Advocate General Seema Shekhar and SK Shukla appearing for the State and other respondents, observed that the official respondents are, however, in view of the provisions of J&K Civil Service (Reference of vacancies and holding of meetings of DPC) Rules 2005 required to ensure reference of vacancies in the promotion quota to DPC/PSC at least twice a year preferably in the month of January and July and also to take necessary steps for having the meetings convened. Court also directed official respondents to take requisite steps in obtaining vigilance clearance and other requisites necessary for processing and sending petitioner's case along with cases of other eligible candidates to the DPC/PSC for considering their entitlement to promotion against the available posts of Assistant Regional Transport Officer. They are further required to take steps to ensure meaningful compliance of the provision of J&K Civil Service Rules. With these observations and directions Court accordingly disposed off the CMPs of vacating status-quo order issued in September 30, 2008 and directed the Registry to list SWP No 1248/2008 after vacation.
