BJP’s Vijaypur candidate doubts results, approaches court

Jammu, Jan O6- While disposing off a petition filed by Chander Parkash Ganga, a BJP leader and defeated candidate from Vijaypur constituency, seeking record including the total turn out of male and female voters, Justice Hakim Imtiyaz Hussain of J&K High Court Jammu Wing, after hearing Adv LK Sharma, appearing for the petitioner, directed the respondent State of J&K through Chief Electoral Officer and Returning Officer (DC Samba) to make available the record or attested copies of the documents mentioned in the petition under rules within a period of one week.
The petitioner in his petition has sought direction to the respondents to issue certified/ attested copies of Form 17-A (Register of turn out of voters), Form 17-C (containing the total turn out of male and female voters), Dairy of the Presiding Officers of all the polling booths and report of the counting of each round given by the Returning Officer to the Media and the detail of change of EVM, if any, during the election process along with its numbers and detail of the postal ballots issued to the belt Forces and polling staff along with their names and voting serial numbers and number of votes received back and the date of receipt of postal ballots of all the polling booths of Vijaypur constituency.
The petitioner, a BJP candidate from Vijaypur, who was defeated by National Conference candidate Surjit Singh Salathia by a thin margin of 1212 votes, has alleged large scale bogus polling at some polling stations especially at serial No 9 polling booth No 7 Bari-Brahmana- E. In the petition it was also alleged that even votes of number of persons who have died and some persons who were lodged in various jails were cast by the polling staff in order to confer undue advantage to the winning candidate. In the petition it was mentioned that copies of Form 17-C was required to be issued to the polling agents of the petitioner at the closure of polling but the said form of about 70 polling booths out of 123 total polling booths have not been issued to the polling agents of the petitioner deliberately to facilitate rigging and casting bogus votes in favour of the winning candidate. The petitioner prayed for issuance of record of polling for filing an election petition. JNF
