HC summons details of Police branches, functions, duties

Jammu, Jan O9- Justice Hakim Imtiyaz Hussain of J&K High Court Jammu Wing in a petition of employees of the State police seeking promotion to the rank of Inspector of Police from the date their 16 juniors have been granted promotion, has directed the respondents to give details of various branches of the police department with duties, functions assigned to each branch, class and category within four weeks.
Court passed this direction in a petition filed by the petitioners/employees of the state police department stating therein that police department being one entity, consist of several wings like Executive, Armed, Auxiliary, Telecommunication etc and all the employees of various wings are members and from one common service as J&K Police, as such common seniority of all the persons borne on establishment should be maintained. They petitioners stated that the requirement of maintaining common seniority has been settled by the various decisions of the State High Court but still respondents have not maintained common seniority, though personnel’s, who are juniors to the petitioners, have been granted promotion to the rank of inspectors while as petitioners have not been granted any such promotion at all. The petitioners are seeking common seniority list of Sub Inspectors of all the wings of police department and also seeking promotions to the rank of inspectors with effect from July 21, 2005, the date when the 16 respondents who were junior to them, were granted promotions. The respondents stated that the petitioners cannot equate themselves with the personnel who have different job to perform and have different service avenues. The working of personnel in police telecom is confined to the telecom sector only.
Justice Hussain, after hearing Adv Amrish Kapoor appearing for the petitioners and Additional Advocate General VK Chopra appearing for the police department, observed that contention of the petitioners that all the employees of department from various wings are members and from one common J&K Police Service. The respondents have on the other hand stated that various wings of the police department have different functions and duties to perform. The respondents may give the details of various branches of the police department and duties and functions assigned to each branch, class and category. The respondents shall inform the mode of appointment to these wings and mode and method of promotions to the higher post with pay/salary of each class/category. Information be filed by the respondents in supplementary affidavit within four weeks, Court directed. JNF
