CAT directs Secy Health to consider the case of petitioner for the posting of Director Health Services

JAMMU, May 11: Suresh Kumar Monga Judicial Member Central Administrative Tribunal directed Principal Secretary to Government, Department of Health & Medical Education, Union Territory of Jammu & Kashmir to consider the Dr. Samir Mattoo Presently posted as Project Director, AIDS Control Society case for posting him as Director, Health Services, Jammu, if he is otherwise eligible in terms of the rules. A further direction is issued to consider his case for granting him the benefits attached to the post of Director Health/Family Welfare with effect from the date when he was posted as Incharge Director, Health/Family Welfare in terms of the principles laid down by the Hon'ble Supreme Court in the case of Suraj Parkash Gupta Vs. State of Jammu & Kashmir 2000 (7) SCC 561 and the Government Order No. 743 GAD of 2007 dated 28.06.2007 (Annexure A-19). Before taking any decision into the matter, the applicant shall also be afforded an opportunity of hearing. The whole exercise shall be undertaken within a period of four weeks from the date of receipt of a certified copy of this order.
This significant order has been passed in a petition filed by Dr. Samir Matoo seeking a direction to Respondent No. 1 to consider the applicant's case for posting him as Director, Health Services, Jammu while keeping in view his eligibility to hold the said post. The applicant has still made one more prayer for issuance of a direction to Respondent No. 1 to grant him the retrospective benefits attached to the post of Director, Health/Family Welfare w.e.f. 04.06.2015, when he was placed as Incharge Director, Health Services. —JNF
