CBI Court framed charges against Patwari in trap case

Jammu, May 25: Special Judge CBI cases Bala Joyti today framed corruption charges against Patwari Ashok Kumar who was caught red-handed by the CBI while accepting bribe money.
According to the CBI that Ashok Kumar posted as Patwari Halqua Jassore R.S.Pura, District Jammu on 15.01.2022 and have demanded Rs.35,000/- as bribe from complainant Harvinder Pal Singh S/o Ajeet Singh R/o Kotli Arjun R.S.Pura for issuance of Fard for plot falling under Khasra No. 281 and accepted illegal gratification (bribe) amounting Rs. 35000/- from complainant and same was recovered from you during trap proceedings by (CBI) team. He demanded Rs.50,000/-as undue advantage from complainant for issuance of Fard.
Special Judge CBI cases Bala Joyti after hearing both the sides observed that For purposes of framing of charge-sheet, cognizance in this case is taken when sanction was placed on record besides there is a notification on record in lieu of DSPE Act as after coming into force J&K re-organization Act 2019 now status of State of J&K has changed into U.T of J&K and Ladakh as vide Sec. 2 of this Act, CBI has got inherent jurisdiction in all the Union Territories to investigate the offence notified u/s 3 of DSPE Act besides both the Acts J&K P.C.Act Samvat 2006 and P.C.Act 1988 are notified by the Central Government in official Gazette. Therefore it cannot be said at this stage that CBI has no jurisdiction therefore the argument is negated. The arguments put forth herein by defence counsel are not tenable in eyes of law as after weighting entire material on record, it appears that there are sufficient grounds for proceeding against accused person as prima facie , offence u/s 7 P.C.Act prima facie is found against accused person.
