Court raises concerns over prosecutor's actions, directs DG prosecution to respond

DODA, June 1: In an attempt to murder case, the Additional Sessions Judge of Doda, Amarjeet Singh Langeh, expressed serious concern over the prosecutor's decision to drop an eye-witness. The judge directed that a copy of the order be sent to the Director General of Prosecution, UT of J&K, requesting his response regarding the underlying reasons for giving up such a crucial witness. The court expects the response from the Director General of Prosecution by the next hearing date to enable appropriate orders to be passed.
During the hearing, the court noted that the prosecution had dropped the witness, Ram Lal Bhagat (Pw-8), on March 8, 2019. The witness was essential as an eye-witness in the attempt to murder case against the accused. The court found it incomprehensible as to why the prosecution chose to forgo such a vital witness without providing a clear rationale. Even if the witness had turned hostile, the prosecution could have cross-examined him to ascertain the truth instead of giving up on him based on speculation. The court expressed concern over the prosecutor's decision, stating that such actions should not occur in an inexplicable manner in the administration of justice.
The court directed that a copy of the order be sent to the Director General of Prosecution, UT of J&K, for a thorough review of the matter. The Director General of Prosecution is expected to provide a response regarding the underlying reasons for giving up an eye-witness by the next hearing date. The case was scheduled for prosecution evidence and the response of the Director General of Prosecution on August 5, 2023.
