Delay in CTE, CTO issuance impacts industrial sector

JAMMU, June 5: The Bari Brahmana Industries Association (BBIA) convened an urgent meeting, chaired by Lalit Mahajan, President, and attended by esteemed mem. Tarun Singla, Sr. Vice President, Ajay Langer, Vice PresidentViraaj Malhotra, General Secretary, Rajesh Jain, Secretary, and Vivek Singhal, Treasurer. The meeting addressed the pressing issue of pending files in the Office of the Chairman of the Pollution Control Committee, causing a delay in granting Consent to Establish/Operate (CTE/CTO) for Orange/Red Category to industrial units since May 1, 2023. The previous Chairman retired on April 30, 2023, leading to a vacant post.
This delay in issuing Consent to Establish for Orange/Red Category has adversely affected the registration process of prospective investors under the NCSS 2021. Without a valid Consent to Establish, industrial unit holders are unable to apply for registration on the portal. Despite bringing this matter to the attention of the Principal Secretary of the Forest Department, no action has been taken, causing significant hardships for the unit holders.
Additionally, the renewal of Consent to Operate files for existing units in the Orange/Red Category is also pending with the Chairman's office. This delay has hindered unit holders from renewing their bank limits, as a valid Pollution Control Consent to Operate is a prerequisite for such renewals. Consequently, unit holders are unable to apply for fiscal incentives offered by the UT/Central Government incentive packages.
In light of the Ease of Doing Business concept, it is recommended that the power to grant Consent to Establish/Operate be delegated to the Member Secretary of the Committee for expeditious file disposal. However, the approval of the Chairman should remain mandatory for the issuance of Red Category Consent to Establish/Operate.
The BBIA earnestly appeals to the Honorable Lt. Governor, Manoj Sinha, to intervene in the matter and delegate the necessary powers to the Member Secretary of the J&K Pollution Control Committee for clearing the backlog of pending files until a new Chairman is appointed.
